Our Service

TalkCity.com is a random video chat platform operated on our own software, connecting users with one another for live, one-on-one conversations. The service is currently provided 100% free of charge: there are no subscriptions, premium features, or paid products of any kind on TalkCity.com. Should we introduce paid features in the future, these Terms and our Billing & Refunds policy will be updated before any such features go live.

Affiliate and Third-Party Disclaimer

TalkCity.com may review, reference, or link to third-party tools, services, or platforms, including through affiliate links from which we may earn commissions when users click through or subscribe to third-party services. We do not own or operate those third-party services. Use of any third-party service is at your own risk and is subject to the terms, conditions, and privacy policies of those providers. Talk City accepts no responsibility or liability for the content, policies, or practices of third-party sites.

Access and Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use TalkCity.com strictly in accordance with this Agreement. This Agreement does not create any agency, partnership, joint venture, or employment relationship between you and us.

We reserve the right to suspend or discontinue Website operation temporarily or permanently, including for:

  • Technical issues such as hardware/software failures or cyberattacks.
  • Updates and improvements to maintain performance.
  • Legal or privacy-related concerns.
  • Business or commercial reasons.

We are not responsible for interruptions, viruses, or security breaches beyond our control, though we will take reasonable steps to restore service. All Internet/data costs are your responsibility.

User Content

Users may transmit text, audio, and video content through Talk City. By doing so, you grant Talk City a worldwide, royalty-free, perpetual license (with the right to sublicense) to use, display, distribute, and adapt such Content on Talk City or affiliated platforms.

We do not claim ownership of your Content, but you are solely responsible for it. You represent and warrant that:

  • You own or control the rights to the Content you share.
  • Your Content does not infringe on third-party rights, including copyright, trademarks, or privacy.
  • Your Content does not violate any laws or regulations.

You agree not to upload or transmit Content that is obscene, illegal, offensive, or used for commercial promotion, and to comply at all times with our Community Guidelines.

All other Website Content, including graphics, design, and branding, is the property of Talk City.

Malicious Activity

You agree not to:

  • Attempt to hack, probe, or test Website vulnerabilities.
  • Circumvent security systems or protective measures, including bans or access restrictions.
  • Use unauthorized bots, crawlers, or data-mining tools.
  • Forge headers or falsify information.
  • Reverse-engineer Talk City software.
  • Interfere with or overload servers (e.g., via viruses, spam, or flooding).
  • Create competing platforms using our software or systems, or encourage others to do so.

Free Service

Talk City is free to use and does not sell any products or services directly. We never request payment details, and no charges are made by TalkCity.com. Any purchases you choose to make on third-party platforms linked from our Website — including through affiliate links — are transactions between you and that third party, governed by their terms, and Talk City is not a party to them. External Links

Talk City may provide links to third-party resources. We do not control or guarantee their content, policies, or security. Your use of external links is at your own risk.

Linking and Embedding

You may link to or embed Talk City on your own sites provided that:

  • You do not obscure or misrepresent Talk City.
  • Your platform does not host illegal or pornographic content.
  • You remove such links immediately if requested by us.

Termination of Access

Talk City may suspend or permanently ban users who violate these Terms, our Community Guidelines, or applicable law. Restrictions may be applied without prior notice.

We are not required to provide notification or justification for bans. Ban duration is determined by Talk City and may be adjusted at our discretion.

Complaints and Abuse

Reports of abuse, copyright violations, or breaches of these Terms may be submitted via the contact methods provided on TalkCity.com.

Attempts to resolve disputes through harassment or illegal behavior may result in permanent suspension.

Limitation of Liability

Talk City is not responsible for actions of Users or Content they create, including the conduct of other users you encounter during live chats. We disclaim all liability for:

  • Service interruptions, viruses, or hardware/software failures.
  • Data loss, unauthorized access, or operator errors.
  • Direct, indirect, incidental, or consequential damages including lost income, lost business, or reputational harm.

You agree to indemnify Talk City and its affiliates against any third-party claims or damages arising from your use of the Website.

Amendments

We reserve the right to update these Terms, our Privacy Policy, Billing & Refunds policy, and Community Guidelines at any time without prior notice. Updated versions are posted on TalkCity.com. Continued use of the Website constitutes acceptance of any amendments.

Governing Law

This Agreement is governed by South African law. Disputes shall be resolved exclusively in the courts of South Africa.

Any claims must be filed within one year of the cause of action. Claims filed after this period are barred.

In case of disputes regarding translations, the English version of this Agreement prevails.
